2. General Terms and Conditions of Use of the Product
The terms of this license form an agreement between CHIPTRONIC and you, the User. Please read them carefully. They apply to the Product acquired and downloaded from this website. By downloading and using the product, you agree to these terms. If you do not agree, do not use the software.
License of Use
This product is licensed, not sold. All content provided by the software is the intellectual property of CHIPTRONIC and is protected by applicable national and international laws. This agreement grants the user only limited rights of use. All other rights remain with CHIPTRONIC.
The User agrees to use the product and software solely as permitted by this agreement, without acquiring any intellectual property rights.
Product Use Rules
The use of the product must follow the technical manual provided. By using it, the user is subject to the Terms and Conditions described here, in addition to the instructions in the manual. The user must not, under any circumstances:
- Reverse engineer, decompile, or disassemble the software and/or hardware, except as expressly permitted by applicable law.
- Attempt to access any restricted or disabled features or circumvent technical limitations of the software.
- Make more copies of the software than specified in this agreement or permitted by law.
- Publish or make the product or software available for others to copy.
- Rent, lease, or lend the product or software.
Any user conduct that constitutes a crime against CHIPTRONIC’s intellectual property may result in legal action.
Software Updates and Internet Access
CHIPTRONIC may provide updates for the product periodically via the internet and may alter or cancel these updates without prior notice. It is the user’s responsibility to install updates for the product to function correctly.
The user must not use access to CHIPTRONIC's website in a way that damages, interrupts access for other users, or attempts unauthorized access to any service, information, account, or network.
Limitations and Interruptions of Use
CHIPTRONIC does not guarantee that the use of the product or software will be free from interruptions, errors, or security failures. Due to the variation in software types and versions in vehicles and motorcycles, and the absence of international standards, the product may have limitations or variations in information and applications depending on the vehicle’s model and module architecture.
Additionally, some features rely on third-party services, such as mobile network operators or servers, and may experience interruptions due to unavailability of these services.
Limitation and Exclusion of Damages
CHIPTRONIC is not responsible for any losses, damages, or injuries of any kind, including lost profits, related to the use of the product. This applies without limitation to:
- Interruptions, limitations, or service outages of third parties affecting the product.
- Claims related to breach of contract, warranty violation, strict liability, negligence, or other damages.
- Any issues related to the product, its software, or content (including code).
This limitation of liability applies even if CHIPTRONIC was previously warned of the possibility of such damages.
Purchases and Use of Credits
By purchasing credits or points, the customer agrees to all applicable methods of purchase and use. CHIPTRONIC reserves the right to modify the balance of points and credits at any time, as necessary.
Applicable Law
This agreement will be governed by Brazilian law, which will determine its interpretation and the resolution of any claims of breach, regardless of conflicts of law principles.
